Terms of use

These terms are between you and BLACKPEBBLE LTD ("we", "us"), a company registered in England and Wales, company number 11884353, registered office 39b Borough Street, Brighton, England, BN1 3BG. They apply when you use Hattie Calls. Please read them, especially section 2 and section 10.

The iPhone app is licensed to you under Apple's standard Licensed Application End User License Agreement. These terms add to it and cover the service we provide through the app. Our privacy policy explains how we use personal data.

1. The service

Hattie Calls places a daily phone call to a parent or other older relative (the "parent") on their own phone. The caller, Hattie, is an automated AI system, and tells the parent so. After each call, family members get a short summary in the app. If the parent doesn't answer, or says something that suggests they may need help, family members who have chosen to get alerts are told by push notification, text message, email or an automated phone call.

The service is for your own personal and family use.

2. Not an emergency service

Hattie Calls is not an emergency service, a personal alarm, telecare, or a medical service.

  • Nobody at BLACKPEBBLE LTD monitors calls or alerts. Alerts go only to your family. If no one in your family acts on an alert, nothing else happens.
  • We don't contact emergency services for anyone.
  • Hattie can only react to what the parent says on a call. She can't know about something that happens between calls or that the parent doesn't mention.
  • Hattie doesn't diagnose, give medical advice or check anyone's health.
  • In an emergency, contact your local emergency services.

You confirm when you set up or join a family in the app that you understand this.

3. Who can use it

  • You must be 18 or over and live in the UK.
  • The parent must be an adult with a UK phone number.
  • The parent must agree to the calls themselves, on the consent call. They need to be able to understand what the service is and make that choice. We don't accept consent given on the parent's behalf, including under a power of attorney.
  • You should talk to the parent about the service before you book the consent call.

If the parent says no, or doesn't clearly agree, the calls won't start. You can book another consent call later.

4. Your family account

  • The person who creates the family is its owner. The owner can invite others and give them roles, and is the only person who can delete the family or hand over ownership.
  • Keep the parent's details, the phone numbers and the alert settings up to date. At least one family member must be set up to receive urgent alerts.
  • Everyone in the family sees the summaries and concerns. Invite only people the parent would be comfortable with.
  • You're responsible for keeping access to your Apple ID and your phone secure.

5. The parent is in charge

The parent can ask Hattie to take a break or stop the calls at any time, and she will. If the parent stops the calls, family members can't restart them. Calls only start again after a new consent call that the parent agrees to.

The parent stopping the calls doesn't cancel your subscription. If you no longer want the service, cancel the subscription as described in section 6.

6. Subscriptions and payment

  • The service costs £14.99 a month or £129.99 a year, including VAT. One subscription covers one parent and everyone in the family. It belongs to the family, whoever pays.
  • You buy the subscription from Apple through the app, and Apple takes payment using your Apple ID. Apple's terms apply to the purchase.
  • New subscribers get one month free. Apple allows one free trial per Apple ID. If you don't cancel at least 24 hours before the trial ends, the subscription starts and you're charged.
  • The subscription renews automatically at the end of each month or year unless you cancel it at least 24 hours before the renewal date.
  • Cancel in your iPhone's Settings: tap your name, then Subscriptions, then Hattie Calls. You can also get there from the app, under More. Deleting the app or the family doesn't cancel the subscription.
  • After a subscription ends, calls carry on for three more days, then pause. Hattie tells the parent on the last call.
  • Refunds are handled by Apple under Apple's policies, at reportaproblem.apple.com. This includes a refund if you change your mind within 14 days. Nothing in these terms affects your legal rights.
  • If we change the price, Apple will tell you before it applies, and ask for your agreement where required.

7. Acceptable use

You must not:

  • set up calls to someone without telling them, or to someone who can't agree to them
  • use the service to deceive, pressure, frighten or harass the parent
  • write notes asking Hattie to hide that she's automated, to push the parent into a decision, or to give medical instructions
  • pretend to be someone else, or give false details
  • try to break, overload, copy or reverse-engineer the service, or get into data that isn't yours

Hattie may reword a note or not pass it on if it breaks these rules. We may suspend or close an account that seriously or repeatedly breaks them. We'll tell you why unless the law or someone's safety prevents it.

8. What Hattie can get wrong

Hattie is an AI system. She can mishear, misunderstand or leave things out. Summaries can contain mistakes. Some alerts will turn out to be nothing, and she can miss things that matter. Use summaries and alerts as a prompt to check in with the parent, not as a reliable account of their health or wellbeing.

9. Availability

We work to make every scheduled call, but calls depend on things we don't control, including phone networks, the parent's phone line, power and broadband, and the companies we rely on. Digital landlines don't work in a power cut or broadband outage. We don't promise that every call or alert will get through. We may pause the service for maintenance, and we'll try to do that outside call times.

We may change the service, for example to improve it or to follow the law. If a change makes the service significantly worse for you, we'll tell you in advance and you can cancel.

10. Our responsibility to you

  • We'll provide the service with reasonable care and skill. If we don't, you have rights under the Consumer Rights Act 2015. Citizens Advice can explain them.
  • We're responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We're not responsible for loss or damage that isn't foreseeable.
  • The service is designed to prompt families to check in. It isn't designed to detect or respond to emergencies, as section 2 explains. We're not responsible for harm that happens because an emergency wasn't raised on a call, or because no one acted on an alert, unless we caused it by our own negligence or by breaking these terms.
  • The service is for personal use. We're not responsible for business losses, such as lost profit or lost business opportunity.
  • Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law doesn't allow us to limit or exclude.

11. Ending the service

  • You can stop using the service at any time. Cancel the subscription with Apple, and, if you're the owner, delete the family in the app under More, then Privacy & data. Calls stop at once and the family's data is deleted after seven days, as our privacy policy explains.
  • We may suspend or end your access if you seriously or repeatedly break these terms.
  • If we stop providing the service for any other reason, we'll give you at least 30 days' notice and tell you how to get a refund for any period you've paid for but won't receive.

12. Changes to these terms

We may update these terms, for example when the service or the law changes. If a change matters, we'll tell you in the app or by email before it takes effect. If you don't agree, you can cancel before then.

13. Complaints

If something has gone wrong, email hello@hattiecalls.co.uk. We'll reply within five working days and try to put it right.

14. Law and courts

These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales. If you live in Scotland, you can also bring proceedings in Scotland, and if you live in Northern Ireland, in Northern Ireland.

If a court decides part of these terms can't be enforced, the rest still applies. No one other than you and us has rights under these terms.
